The Eurasian Natural Resource Company (ENRC) emerged victorious at the end of 2011 when the European Court ruled that the European Commission had overstepped its authority in imposing a 6.5% anti dumping duty on imports of Silico Manganese from Kazakhstan.
The Court found that the European Commission used flawed assumptions in assessing the duties on Silico Manganese and that they should be eliminated. Furthermore, the Court directed the European Commission to refund all duties that were collected since the original duty was imposed.
The judgement by the European Court is significant because it paves the way for greater scrutiny and accountability of anti dumping duty calculations in future.
